Visual Art Guide Application

This form is for artists to apply for consideration to be featured in the Visual Art Guide. To apply you MUST pay for your Portal first, the cost includes a $10 application fee. If you are selected there are no other costs. If you are NOT selected you will be refunded your Portal fee minus the $10 application fee. For example - if you apply to be in two categories in the Expanded Portal, the cost would be $169 per Portal, totaling $338. If you're only selected be in one, you will be refunded $159 - the cost of the 2nd Portal minus the $10 application fee.

There is a $10 application fee per category.

You can apply to be in as many categories as you wish but artists can only be featured in a maximum of TWO categories.

What We Need:

Visual Art Guide Portal - Your payment of $169 per category. You can submit as many images of your work for review as you want.  At least 4 images must meet the criterion for inclusion.*

 

*The Visual Art Guide uses the same criterion as Best Of Artists in seeking outstanding artists whose work demonstrates style, innovation and uniqueness.

    Best Of Artists and Artisans (BOAA) reserves the right to review and edit, refuse publication or remove from publication any imagery, text or other content without liability to BOAA that it believes is in violation of this agreement, or is unsuitable for our viewing audience.

    A. BOAA reserves the right to verify copyright claims and to remove any text, imagery or other content believed to be, in the sole discretion of BOAA, in violation of another parties' copyright, trademark, patent or servicemark, unless written permission is given to BOAA by the owner of such copyright, trademark, patent or servicemark. Removals of this nature will not be subject to a refund.

    B. BOAA is not responsible for Backing up submitted imagery and text - please make sure you have duplicates of slides, photos and copy before submitting them for publication.

    C. BOAA is not responsible for the validity of representations or claims made by clients of any kind and BOAA shall be held harmless in regards to the authenticity, condition or quality of any art, bought or sold, through the services provided by BOAA.

    D. BOAA is not responsible for persons copying imagery from our World Wide Web site. If this is of particular concern to you, please talk to our staff about services we can provide to help limit this activity. We will be more than happy to assist in the prosecution of any violations of copyright with testimony or information.

    Section II - Payment Terms

    A. Payments can be made online using Pay Pal

    B. A billing statement can be emailed to you via Pay Pal

    C. All non-internet payments should be directed to:

    Acceptable payment forms include check or money orders, made out to Kennedy Promotions LLC, and drawn on a US bank in US dollars. All payments are for one year of listing in BOAA US Visual Art Guide.

    D. The Client has 72 hours after Kennedy Promotions LLC receives the payment to cancel their order.

    E. The 12 month contract begins when the artists Portal goes "live".

    F. BOAA reserves the right to change the amount of any fee or institute new fees and charges. This has no effect on the Client once they have entered into a 12 month contract.

    G. BOAA does not guarantee the sale of any product or work or the use of any services by being in the Guide.

    Section III - Customer Rights and Responsibilities

    A. Client is responsible for all representations or claims made on behalf of their artwork, business or represented artists. BOAA cannot be responsible for verification of such claims or representations.

    B. You, as a client, assert that you have the right to promote all artists, businesses and items submitted by you for publication on www.bestofartists.com. Client shall indemnify and hold harmless BOAA against any liabilities, losses, damages or claims arising out of (i) the negligence of the client, its agents, or employees; and (ii) any breach of any representation or promise of client herein contained. Any copyright disputes that arise after publication will result in the removal of the works or artists in question from Bestofartists.com and the BOAA Visual Art Guide, until written documentation is submitted to Kennedy Promotions LLC legally affirming the claim of copyright to the client. No refunds will be issued for works found in violation of copyright or removed due to disputes.

    C. Client is responsible for informing BOAA staff of the sale of listed items or the discontinuation of a representational agreement with represented artists. BOAA will gladly replace any changed items or artists, subject to the terms of purchased package.

    D. Client shall not use BOAA to transmit or publish any material that is defamatory, inaccurate, obscene or illegal.

    Section IV - Miscellaneous

    A. This Client Agreement contains the entire agreement between all parties hereto and shall not be changed or modified in any manner except by instrument in writing executed by the parties hereto.

    B. Should any party breach any of the terms or conditions of this Client Agreement, the prevailing party in any arbitration or litigation brought to enforce this Client Agreement shall be entitled to costs and reasonable attorney's fees arising out of or resulting from the breach.

    C. This Client Agreement is made pursuant to and shall be governed by the laws of the State of Virginia.
